Copyright and AI generation sites
In line with the same philosophy, many AI image generation tools operate under Creative Commons CC0 license. Others may use a different open source or proprietary algorithms and the associated licenses.
Dall-e-2 (OpenAI) states the following for copyright:
Respect the rights of others.
- Do not upload images of people without their consent.
- Do not upload images to which you do not hold appropriate usage rights.
- Do not create images of public figures.
Stable Diffusion
Stable Diffusion spaces on Huggingface have the CreativeML OpenRAIL++https://huggingface.co/stabilityai/stable-diffusion-2/blob/main/LICENSE-MODEL) license. The terms on the site state that
"The authors claim no rights on the outputs you generate, you are free to use them and are accountable for their use..."
Other Sites
Finally, websites like Tinywow allow 'free' usage of creation and use of the images, but they state,
"All images created are free for personal and commercial use. Images created may be made available in our gallery for anyone to use."
#What about AI generated Fan Art?
This is another area that needs further investigation. Depending on the country or the jurisdiction, the Laws of the Land may vary.
Interestingly enough, an AI generated image was copyrighted recently. (Source: petapixel) A testament to my previous statement that like any new rapidly developing technology, the area of copyright and royalties for AI generated creative work (not just art) will see a lot of new developments in the times to come.
Remember to check the terms of service related to rights for images, licensing terms etc for any site where you generate AI images.
There are some sites where the terms of service are easier to understand compared to some others. While I am not a trained legal professional or an expert on copyright, I found the terms on artiso site a tad lengthy but readable and understandable. Overall, the Licensing terms for Stockai are the easiest to read and understand.
